Covered websites and service
These terms apply to the Cranberry Peak and PayerAnalytics websites, including the Hospital Price Transparency Checker (collectively, the “Site”). The Site is operated by Cranberry Peak Corp. (“Cranberry Peak,” “we,” or “us”). We may update, suspend, or discontinue any part of the Site at any time.
Informational tool; no CMS determination
The checker provides a limited automated review of publicly available website content. It is not affiliated with, approved by, or endorsed by the Centers for Medicare & Medicaid Services (“CMS”). It does not perform a CMS audit, provide legal advice, or make a legal or regulatory compliance determination. Use of the Site does not guarantee compliance or prevent CMS review, enforcement, or penalties.
You are responsible for independently reviewing current CMS requirements and the underlying hospital materials and for obtaining appropriate legal or compliance advice before making decisions.
Automated results and third-party content
Results may be incomplete, inaccurate, delayed, or outdated. The checker depends on third-party websites and files that Cranberry Peak does not own or control. Website restrictions, security tools, outages, redirects, dynamic content, file structure, and other technical conditions may prevent or limit review. A finding that evidence was observed does not establish compliance, and a result marked for review or not determined does not establish noncompliance.
Links to third-party websites are provided for convenience and evidence. Cranberry Peak does not control, endorse, or assume responsibility for their content, security, availability, or privacy practices.
No warranties
THE SITE, CHECKER, RESULTS, AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, CRANBERRY PEAK AND ITS LICENSORS AND SUPPLIERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, CURRENTNESS, AVAILABILITY, MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CRANBERRY PEAK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, OR BUSINESS; REGULATORY PENALTIES; OR DAMAGES ARISING FROM USE OF, RELIANCE ON, OR INABILITY TO USE THE SITE OR RESULTS, REGARDLESS OF THE THEORY OF LIABILITY OR WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Acceptable use
You may use the Site only for lawful purposes. You may not interfere with the Site, bypass access controls, introduce harmful code, attempt unauthorized access, misrepresent results as a CMS determination, or use the Site in a way that infringes another party’s rights.
Intellectual property
The Site, software, design, text, graphics, logos, and other Cranberry Peak content are protected by applicable intellectual-property laws. Cranberry Peak grants you a limited, revocable, nonexclusive right to use the Site for its intended purpose. Third-party names, marks, and content remain the property of their respective owners.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cranberry Peak and its officers, directors, employees, agents, licensors, and suppliers from claims, liabilities, damages, and reasonable costs arising from your misuse of the Site, violation of these terms, or violation of another party’s rights.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Exclusive jurisdiction for disputes relating to the Site resides in the state and federal courts located in Massachusetts. If any provision is unenforceable, the remaining provisions remain in effect.
Changes and contact
